Introduction to the Terms

These Terms of Service are binding agreement (the “Terms” or “Agreement”) between TimeMoneyPatience Ltd, and https://timemoneypatience1.myshopify.com, a company duly incorporated under the United Kingdom laws, bearing company registration number { }, with a registered address at TMP Office, 376 Kingsland Road, London, E8 4AA (hereinafter “Service Provider”, “us”, “we”, “our” or “TimeMoneyPatience”), as the operating of services, including any content or information provided as part of the Site or related services, as set out hereafter, and the person, persons or entity (“Company”, “User”, “Client”, “you” or “your”) using such services (each a “Party” and collectively the “Parties”)

You hereby, agree that TimeMoneyPatience will not be responsible for any loss, or mitigation risk when using the TimeMoneyPatience services. Certain features of the Service may be subject to additional guidelines, terms, or rules (“Supplemental Terms”), which will be displayed in connection with such features. All such Supplemental Terms are incorporated by reference into this Agreement.

Service Provision

TimeMoneyPatience sell bitcoin mining machines provided on or in connection with those services (collectively, the “Service”). You expressly acknowledge and agree that, you are solely responsible for your activity and any risk of loss at all times.

Eligibility

The TimeMoneyPatience service is open only to individuals who are 16 years and above and have the right and authority to enter into this Agreement, are fully able and competent to satisfy the terms, conditions, and obligations herein and who warrant that such party is the lawful user thereof.

Use of the Service

For purposes of these Terms, “user”, “you”, and “your” means you as the user of the Service. If you use the Service on behalf of a company or other entity then “you” includes you and that entity, and you represent and warrant that (a) you are an authorized representative of the entity with the authority to bind the entity to these Terms, and (b) you agree to these Terms on the entity’s behalf.

BY CLICKING TO ACCEPT AND/OR USING OUR SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL OF THE TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.

Your Agreement with Us

You agree that TimeMoneyPatience is not a financial institution, broker, or creditor. We aim to provide bitcoin mining machines, within the website. We do not have custody or control over the mining machine you are purchased and we do not execute or effectuate the mining machine purchases. To use our Service, you must agree to these terms.

Mining Contracts

When you use our website, you agree to enter into an Agreement with us to provide you the Service, and we accept your request by sending you an order confirmation (hereinafter referred to as “the Order Confirmation”); a contract (hereinafter referred to as “the Mining Contract”) to provide the Service is formed. Upon commencement of Service, we will complete your purchase and ship your Mining Hardware to you to carry out mining of Cryptocurrencies.

User Login

To use this website, you may be asked to register an account and provide private information such as email address, full name, phone number etc. Upon login TimeMoneyPatience may access required information like the device id, IP location etc. You agree to be responsible for ensuring the accuracy of your information, and maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address it accordingly.

We reserve all rights to terminate accounts, edit or cancel orders in our sole discretion.

The TimeMoneyPatience Mining

TimeMoneyPatience provides a high-performance cryptocurrency mining machine designed by Bitmain (collectively “mining”). The mining machine is referred to as The Antminer S19J Pro 104T, which is capable of mining various cryptocurrencies such as Bitcoin Cash, Bitcoin, and other SHA-256-based coins with a hashrate of up to 104 terahashes per second (TH/s), making it one of the most powerful miners on the market.

TimeMoneyPatience makes no representations or warranties as to the quality, origin, or ownership of any mining machine found on the service. TimeMoneyPatience shall not be liable for any errors, misrepresentations, or omissions in, of, and about, the content, nor for the availability of the content. TimeMoneyPatience Ltd shall not be liable for any losses, injuries, or damages from the purchase, inability to purchase, display, or use of content.

Payment Methods

We accept the following payment methods to complete your purchase on the site. I.e bank cards and bank transfers, payments via electronic or online payment solutions, such as Paypal etc. Additional limitations and restrictions apply subject to region, and/or currency, and/or amount of payment. TimeMoneyPatience reserves the right to amend the list of payment methods without notification of its user’s. Bank deposits or any other type of deposits from third parties to the User Account will not be accepted.

Our Suppliers

We use the Site to resell the Mining Machine provided by our Suppliers. For the avoidance of doubt, the Suppliers retain the responsibility to the final users for providing the Services.

In some jurisdictions, the claims against our Suppliers may not be enforceable. To the extent that is the case, the provisions of this Agreement that limit our liability or disclaim warranties also apply to our Suppliers

Limitations and restrictions

The User will not be allowed to open multiple account and use TimeMoneyPatience services if it is incorporated in one of the following non-serviced jurisdictions. TimeMoneyPatience may also enforce access restrictions based on the geo-location of the user, which may encompass general information regarding its service; The User will not be allowed to open an account and use TimeMoneyPatience services if its business activities are in one or more restricted sectors of activity; The User will not be allowed to open an account and use TimeMoneyPatience services. TimeMoneyPatience grants the User a limited, non-exclusive, non-transferable license, subject to these Terms, to access and use the TimeMoneyPatience Site, and related content, materials, information (collectively, the ‘Content’) solely for approved purposes as permitted by TimeMoneyPatience from time to time. Any other use of the TimeMoneyPatience Site or Content is expressly prohibited and all other right, title, and interest in the TimeMoneyPatience Site or Content is exclusively the property of TimeMoneyPatience; and

The User must use the Services in a lawful manner, and must obey all laws, rules and regulations applicable to the use of the Services.
The User may not use the Services to enable any person to benefit from any activities that violate the letter or spirit of any of these Terms, or the applicable laws and/or regulations.
In the event these Terms or the Services are terminated for any reason, you acknowledge and agree that you will continue to be bound by these Terms. Following this, you shall immediately cease use of the Services and any license granted to you under any agreement related to your use of the Services shall immediately terminate.
To avoid any double spending attack, User agree never to do simultaneous login from multiple devices for same account.
Once an account is created by a User, the user agree to use the account only on same device it was created. However, this restriction can be changed in the future. Upon loss of the device user agree to contact us via theboss@miners.kamrulweb.com, for further guidiance for a new verification of identity.

TimeMoneyPatience may from time-to-time change or discontinue any or all aspects or features of the Service, including by deactivating or deleting Accounts that TimeMoneyPatience in its sole discretion determines have been abandoned. In such events, you may no longer be able to access, interact with or, read the data from the Service.

Our Role in Online Trading

TimeMoneyPatience is not a brokerage or a clearing agent. TimeMoneyPatience does not act as a principal in securities, options, or mutual fund transactions or make a market in any security, equity or mutual fund; solicit orders; make discretionary investments on your behalf; provide internally generated research or advice regarding securities; determine suitability as to the type and/or frequency of transactions in your account(s); or provide you with investment recommendations or investment, tax or legal advice.

KYC Procedure

TimeMoneyPatience is appropriately implementing AML/CTF and security measures to diligently detect and prevent any malicious or unlawful use of TimeMoneyPatience Services or use, which is strictly prohibited by these Terms, which are deemed as your agreement to provide required personal information for identity verification. Security measures include a KYC procedure, which is aimed at determining the identity of an individual user or an organisation. We may ask you to complete this procedure before enabling some or all functionalities of the TimeMoneyPatience platform and provide its services. A KYC procedure might be applied as a security measure when:

changing the email address linked to your TimeMoneyPatience Account,
losing or changing your 2FA code;
gaining access to all or a portion of TimeMoneyPatience Services, and its related services or any portion thereof if they were disabled and
activating your TimeMoneyPatience Account if it has been deactivated due to its inactivity and/or security or other reasons.

Ownership

You acknowledge and agree that TimeMoneyPatience (or, as applicable, our licensors ‘TimeMoneyPatience’) own all legal rights, titles and interests in and to all elements of the TimeMoneyPatience. The graphics, design, systems, methods, information, computer code, software, services, “look and feel”, organization, a compilation of the content, code, data, and all other elements of the website and site (collectively, the “TimeMoneyPatience Ltd Materials”) are Owned by TimeMoneyPatience Ltd, and are protected by copyright, trade dress, patent, and trademark laws, international conventions, other relevant intellectual property and proprietary rights, and applicable laws. All TimeMoneyPatience Materials are the copyrighted property of TimeMoneyPatience or its licensors, and all trademarks, service marks, and trade names contained in the TimeMoneyPatience Materials are proprietary TimeMoneyPatience or its licensors. Except as expressly set forth herein, your use of the site and app does not grant you ownership of or any other rights with respect to any content, code, data, or other materials that you may access on or through the website. We reserve all rights in and to the TimeMoneyPatience Materials not expressly granted to you in the Terms.

Third-Party components

The Service and Content may include components, including software components, that are provided by a third party and that are subject to separate license terms, in which case those license terms will govern your access to and use of such components. Our Service and/or any Third-Party Property may include terms governing the use of such service, including license terms.

Investigations

If TimeMoneyPatience becomes aware of any possible violations by you of this Agreement, TimeMoneyPatience reserves the right to investigate such violations. If, as a result of the investigation, TimeMoneyPatience believes that any illicit or otherwise criminal activity may have occurred, TimeMoneyPatience reserves the right to refer the matter to, and to cooperate with, any and all applicable legal authorities. TimeMoneyPatience is entitled, except to the extent prohibited by applicable law, to disclose any information or materials on or in the Service, including Content, in TimeMoneyPatience’s possession in connection with your use of the Service, to (i) comply with applicable laws, legal process or governmental request; (ii) enforce this Agreement, (iii) respond to any claims that Content violates the rights of third parties, (iv) respond to your requests for User service, or (v) protect the rights, property or personal safety of TimeMoneyPatience, its users, or the public, and all law enforcement or other government officials, as TimeMoneyPatience in its sole discretion believes to be necessary or appropriate. By agreeing to this Agreement, you hereby provide your irrevocable consent to such monitoring. You acknowledge and agree that you have no expectation of privacy concerning your use of the Service, including without limitation text, voice, or video communications.

Risk Assumption

If you choose to use TimeMoneyPatience Platform and Services, it is important that you remain aware of the risks involved, that you have adequate technical resources and knowledge to bear such risks and that you monitor your transactions carefully.

You understand that TimeMoneyPatience Platform and Services, blockchain technology, Bitcoin, all other Digital Assets, proof of work concept and other associated and related technologies are new and untested and outside of TimeMoneyPatience’s control. You acknowledge that there are major risks associated with these technologies. In addition to the risks disclosed below, there are risks that TimeMoneyPatience cannot foresee and it is unreasonable to believe that such risk could have been foreseeable. The performance of TimeMoneyPatience’s obligation under these Terms will terminate if market or technology circumstances change to such an extent that (i) these Terms clearly no longer comply with TimeMoneyPatience’s expectations.

Disclaimer

The materials on the web site are provided “as is”. TimeMoneyPatience Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. further, Owned by TimeMoneyPatience Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

Limitations

In no event shall Owned by TimeMoneyPatience Ltd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Owned by TimeMoneyPatience Ltd’s website, even if TimeMoneyPatience Ltd authorized representative has been notified orally or in writing of the possibility of such damage. General Warranty

We are committed to provide quality and reliable products to all our User’s and ensure our Users enjoy the best possible experience, while striving to ensure that every product we offer meets the best rigorous standards of quality and performance. We offer a 180 days warranty for all our products. We understand that purchasing a high-value item such as an Antminer S19J Pro can be a significant investment, which is why we offer a comprehensive warranty on all our products.

This general warranty does not apply to any defect in the product arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, if you use the product in a way that we do not recommend, your failure to follow instructions, or any alterations or repair you carry out without our prior written approval.

The user agree that all sales are final. Refunds will only be granted, if the following events do not void the warranty:
User removes/replaces any components of the item.
Damage was caused by poor power supply, lightning or voltage surges;
Miner/boards/components damage due to water immersion or corrosion due to wet environment.
User removes/replaces any components by himself without first receiving permission from us;
For all repairs or RMA, whether within warranty or not, the user must return the defective parts at his/her own expense.
If you receive a defective product or notice any wear or tear with the item, please inform us by emailing to theboss@miners.kamrulweb.com within 3 days from the date the package is received. We will be happy to help.

TimeMoneyPatience Ltd does not take any responsibility for or compensate for any loss as a result of downtime caused by delays in transportation and or damaged / defective items. The warranty provided herein is covered by the manufacturer of the products and not TimeMoneyPatience Ltd. So, therefore, the warranty is subject to the warranty terms offered by the manufacturer of each product. All claims will need to be dealt directly with the manufacturer and not TimeMoneyPatience Ltd. The User agree to return the defective equipment at their own expense to the Manufacturer by first sending a message to TimeMoneyPatience Ltd Customer support. Ensure to send back the product in its original packaging to avoid damage during transit. If there is further damage caused during returns your warranty may not be covered.

The warranty provided herein is subject to the warranty terms offered by the manufacturer of the product. TimeMoneyPatience Ltd will not pay for any loss of downtime or delay caused by customs or negligence of the User. In cases where the warranty is void or after the warranty period, the equipment can be repaired for the cost of parts and labor.

Applicable Laws & Regulations

Subject to the Applicable Laws & Regulations these Terms and all Transactions are subject to Applicable Laws and Regulations. Nothing in these Terms shall exclude or restrict any obligation which we have to you under the Applicable Laws and Regulations. We may take or omit to take any action we consider necessary to ensure compliance with any Applicable Laws and Regulations. All Applicable Laws and Regulations and whatever we do or fail to do in order to comply with them will be binding on you; such actions that we take or fail to take for the purpose of compliance with any Applicable Laws and Regulations shall not render us or any of our directors, officers, employees or agents liable.

Revisions and Errata
